At the Sussex County Sheriff's Office, West Complex, 22215 DuPont Boulevard, Georgetown, Delaware, Georgetown Hundred, Sussex County, State of Delaware, the following described real estate to wit:

All that certain lot, piece or parcel or land, situate, lying and being in Baltimore Hundred, Sussex County and State of Delaware, being more particularly known and designated as LOT NUMBER 38 of SEA COUNTRY ESTATES as shown on a plot of record in the Office of the Recorder of Deeds in and for Sussex COUNTY, in Georgetown, Delaware in Plot Book 12, Page 30, as revised in Plot Book 39 Page 130, and being more particularly described according to a survey prepared by Delaware Surveying Services dated October 16, 2006, as follows, to wit:

BEGINNING at an iron pipe situate on the northerly right of way of Helen Lane (50' Wide), said pipe being a corner for these lands and lot 37; thence by and with the aforesaid northerly right or way or Helen Lane. North 55 degrees 22 minutes 30 seconds West 76.80' to an iron pipe being the beginning or a curve bearing to the right; thence, by and with said curve, a delta angle of 85 degrees 43 minutes 50 seconds, a radius of 25.00' and an arc distance of 37.40' to an iron pipe situate on the easterly right of way of Yolanda Street (50' Wide): thence, by and with the easterly right of way of Yolanda Street North 10 degrees 21 minutes 20 seconds East, 177.36' to an iron pipe, said pipe being a corner for these lands and Lot 29; thence, by and with Lot 29 and Lot 30 South 55 degrees 22 minutes 30 seconds East 114.93' to a rebar, said rebar being a point on line of Lot 30 corner for these lands and Lot 37; thence by and with Lot 37, South 34 degrees 37 minutes 30 seconds West 200.00' to the point and place of beginning, being and containing 21,832 square feet or land, more or less.

Being the same lands and premises which John E. McGinn, did grant and convey unto Sean M. McGraw and Jennifer M. Izzi, by deed dated October 23, 2006 and recorded on October 25, 2006 in the Office of the Recorder of Deeds, in and for Sussex County, State of Delaware, in Deed Book 3375 at Page 184.

Registration is required for all bidders prior to sale. A $4,000.00 deposit (Cash or Cashiers/certified check payable to Sheriff of Sussex County) and valid driver’s license or photo I.D. are required to register.

TERMS: 20 percent of the purchase money will be demanded on day of sale (The $4,000.00 Bidder Registration Fee will be credited to the 20% deposit). Cash, Certified Check or Cashier's Check, is required. The balance is to be paid on or before March 19, 2012. Sale subject to confirmation by the Superior Court on March 23, 2012 and also subject to a 1 1/2 percent Delaware Realty Transfer Tax; 3/4 percent to be paid by the Seller and 3/4 percent to be paid by the Purchaser. Also subject to 1 1/2 percent Sussex County Realty Tax, 3/4 percent to be paid by the Seller and 3/4 percent to be paid by the Purchaser. Any further Transfer Tax is the responsibility of the Purchaser.
